Terms of Service

01. Acceptance of Terms

By downloading, installing, accessing, or using the Gowaal mobile application ("App") or related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.

We reserve the right to modify these Terms at any time. Material changes will be communicated via the App or our website. Continued use of the App following any update constitutes your acceptance of the revised Terms.

02. Description of Service

Gowaal provides a hyper-local digital daily services ledger platform designed to assist suppliers ("Vendors") and households ("Customers") in recording, tracking, and settling recurring morning and evening deliveries such as milk, water jars, and tiffin services.

03. Account Registration & Security

• Phone Authentication: You must register using a valid mobile phone number capable of receiving One-Time Passwords (OTP).
• Accuracy of Information: You agree to provide true, accurate, and current information when creating your profile and business details.
• Account Security: You are responsible for safeguarding your device and account access credentials. You must notify us immediately of any unauthorized access or security breach.

04. Vendor & Customer Responsibilities

A. Vendor Responsibilities

• Ensure daily delivery quantities and rates entered into the ledger represent honest and accurate service fulfillment.
• Promptly review and respect Customer vacation and shift pause requests submitted through the App.
• Maintain independent regulatory compliance, food safety standards, and local licenses required for your delivery trade.

B. Customer Responsibilities

• Timely verify daily delivery entries logged by your paired vendor.
• Submit vacation pauses in advance before shift cutoff windows to prevent unnecessary deliveries.
• Settle verified monthly ledger balances directly with your vendor in accordance with your agreed payment schedule.

05. Digital Ledger & Dispute Window

Gowaal acts as a mutual single source of truth for delivery records:

• Verification Window: Customers are encouraged to review delivery logs daily. In the event of a discrepancy (e.g., incorrect quantity or missed delivery), the Customer should notify the Vendor or raise a dispute prompt through the App within the grace window (typically 24 to 48 hours).
• Ledger Reconciliation: While Gowaal provides audit trails and immutable delivery logs once locked, resolution of discrepancies regarding physical delivery is the mutual responsibility of the Vendor and Customer.

06. Vacation Lock & Multi-Shift Pauses

The App enables customers to schedule service pauses for upcoming vacation periods:

• Pauses must be scheduled prior to the Vendor's designated shift cut-off time (e.g., prior to 8:00 PM the previous evening for morning deliveries).
• Once locked, deliveries for paused dates will reflect a quantity of zero (0) in billing calculations.

07. Payments & Settlements

Gowaal generates digital statements and calculation summaries based on verified ledger entries:

• Direct Settlement: Unless an in-app payment processing feature is expressly utilized, all payments (via cash, personal UPI, or direct bank transfer) occur directly between Customer and Vendor.
• No Payment Escrow: Gowaal does not hold funds in escrow or guarantee payments by Customers or refunds by Vendors.

08. Prohibited Conduct

You agree not to:

• Use the App for fraudulent, deceitful, or unlawful billing practices.
• Attempt to reverse-engineer, decompile, or tamper with the App's source code, offline database sync, or APIs.
• Transmit viruses, worms, or malicious code through the App or associated endpoints.
• Harass, intimidate, or threaten other users of the service.

09. Intellectual Property Rights

All intellectual property rights in the Gowaal mobile application, branding, logos, interfaces, layouts, algorithms, and documentation are the exclusive property of Gowaal and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your internal personal or business service ledger purposes.

10. Disclaimers & Limitation of Liability

"AS IS" BASIS: The App and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, Gowaal, its developers, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, data, or goodwill resulting from:

• The quality, hygiene, pricing, or failure of physical deliveries by any Vendor.
• Any disputes or defaults arising in payments between Customers and Vendors.
• Temporary service interruptions, network sync delays, or technical outages.

11. Termination

You may terminate these Terms at any time by ceasing use of the App and deleting your account. We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in conduct detrimental to other users or the platform.

12. Governing Law & Contact Information

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
